Lindsay Lohan on 911 Call -- I Told You So!

Lindsay Lohan wins again ... at least according to Lindsay Lohan -- who believes the 911 call of the Betty Ford incident backs her version of what went down with Dawn Holland.

TMZ was first to publish the 911 call Lindsay made on December 12. On the recording, Lindsay and Dawn are heard having a heated argument ... and Dawn claims Lindsay hit her with the phone.

Sources close to Lindsay tell TMZ she feels the 911 call vindicates her because it makes Dawn seem "rude," "aggressive" and "inappropriate."

We're also told she thinks it proves Dawn was only after money from the start. Very early in the call Dawn says, "Get ready to be sued."

Ultimately, Lindsay does win -- earlier this week the Riverside County District Attorney's Office announced it would not file charges against Lindsay over the incident.

D.A. Won't Prosecute Lindsay in Betty Ford Case

TMZ has learned ... The Riverside County District Attorney has decided not to file criminal charges against Lindsay Lohan in connection with the altercation last December between Lindsay and a Betty Ford staffer.

Sources tell us the D.A. believes there is "insufficient evidence" to prosecute Lindsay.

The Palm Desert Police Department had been investigating the confrontation between Lindsay and former staffer Dawn Holland, but ultimately the D.A. felt the firepower wasn't there.

So Lindsay only has one criminal case in play now.

Lindsay Lohan Made A Deal With Dawn Holland

Lindsay Lohan made a secret deal to meet with Dawn Holland -- the Betty Ford Center worker Lindsay allegedly attacked -- and the plan was that a photog would take pictures of the two together, sell them and Dawn would pocket the cash ... sources familiar with the deal tell TMZ.

The plan -- hatched BEFORE Dawn decided not to pursue criminal charges against Lindsay -- was that Dawn would make $10,000 from the sale of the photos.

Sources connected with the deal tell us the point was not for Dawn to get money in exchange for dropping her case -- but rather for Lindsay to "help her out."

Sources say the deal fell apart when Lindsay's business manager, Lou Taylor, put the kibosh on the plan.

Dawn was pissed, felt Lindsay was "disrespecting" her, got a new lawyer and may pursue the battery case.

Lindsay Lohan Case Referred to District Attorney

TMZ has learned ... Lindsay Lohan's fate is now in the hands of the Riverside County District Attorney, who will decide whether to charge her in the Betty Ford brouhaha with the former staffer.

The Palm Desert Police Department has turned its investigation over to the D.A., who will decide whether to charge Lohan with battery.

The case would be an uphill battle, because alleged victim Dawn Holland says she will not cooperate and does not want Lindsay prosecuted.

No word on when the D.A. will make a decision.

Lindsay Investigated For Multiple Violations

County Probation Office. As RadarOnline.com previously reported, if the Mean Girls star, 24, is found to have violated the conditions of her probation, she could be headed back to jail.

Lindsay is under new scrutiny following her altercation with Betty Ford staffer Dawn Holland, who was fired after the incident for selling confidential medical information about Lohan to TMZ.

On Wednesday, Palm Desert Police Department released this new statement to Radar Online:

Over the last few weeks, Investigators for the Palm Desert Police Departments Investigations Bureau have been investigating the battery between Ms. Lohan and a Betty Ford Center staff member, Dawn Holland. This investigation is now complete and it is anticipated that this investigation will be submitted to the appropriate law enforcement agencies (Riverside County District Attorney and LA County Probation Office) later this week or no later than the early part of next week for their review and any appropriate action.

While Ms. Holland and her attorney have notified Investigators she no longer desires prosecution against Ms. Lohan, the investigation and facts in evidence has revealed other possible violations by Ms. Lohan relating to certain conditions of her probation terms. These additional findings has required investigating officers to conduct additional investigation. It is premature to release these facts and investigative findings at this time as the final completed criminal investigation has not yet been received and reviewed by the appropriate concerned law enforcement agencies. Until this has been completed, no additional information will be released to media requests nor will we be releasing any 911 calls, tapes or recordings as to do so may hinder the judicial process.

Lindsay and her lawyer Shawn Chapman Holley will now be coming up with a battle plan has they try to discredit Holland and the Palm Desert Police Department.

Police: Lindsay Lohan Committed Battery

Police now assert the actress did, in fact, commit battery against a Betty Ford employee in a Dec. 12 scuffle – and plan to hand the case over to local prosecutors for review.

"The investigation determined Ms. Lohan violated several aspects of her probation, including the battery [charge]," the Palm Desert Police Department said in a press release Monday, adding that they plan to notify Lohan's probation officer.

Lohan's attorney, Shawn Chapman Holley, wasn't immediately available for comment. Lohan, 24, was released from rehab Monday and faces a routine Feb. 25 progress review hearing.

L.A. Superior Court Judge Elden Fox previously warned Lohan that any more slip-ups would be met with six months in jail. As of Tuesday, however, the court still hadn't received formal notice of the incident.

Betty Ford employee Dawn Holland was fired the same day she went public with claims that Lohan threw a phone at her and yanked another phone out of her hand, causing a sprain after a confrontation at the famed Rancho Mirage, Calif., clinic.

Holland stated that Lohan was acting "out of control" and had alcohol on her breath and refused to take a Breathalyzer test when she was caught coming home past curfew.

Police continued their investigation despite Holland's decision to recant her claims, with her attorney stating that Holland, a former addict herself, had no desire to see Lohan prosecuted.

Lindsay Faces Possible Probation Violation

The Riverside County District Attorney believes Lindsay Lohan violated her probation in the altercation with a staffer at the Betty Ford Center ... and if the Beverly Hills judge handling her case agrees ... Lindsay could go to jail.

As TMZ reported, Dawn Holland, a staffer at Betty Ford, claims Lindsay assaulted and injured her last month after allegedly violating her curfew.

Holland -- who has since been fired by Betty Ford -- notified authorities by a letter obtained by TMZ that she had no interest in pursuing a criminal case. But the Riverside PD now says the case will be submitted to the District Attorney anyway because police believe Lindsay committed a battery and therefore violated her probation.

One of the terms of probation is that Lindsay must obey all laws.

The Riverside PD is forwarding its file on the case to the L.A. County Probation Office.

Lindsay's Alleged Victim Will Refuse to Cooperate

The ex-Betty Ford staffer who claims Lindsay Lohan assaulted her earlier this month will not only drop her criminal complaint, she'll refuse to cooperate with authorities ... TMZ has learned.

Dawn Holland, who told TMZ earlier this week how Lindsay ripped a phone from her hand causing a severe sprain, now says Lindsay should not be prosecuted.

Holland's lawyer, Keith Davidson, tells TMZ, "Dawn will not continue to press charges against Lindsay, nor will she be assisting any further in the investigation or prosecution."

And this is interesting ... we asked Davidson how his client would respond if she's subpoenaed, and he said, "She won't."

Davidson says Holland and Lindsay share a common bond -- they're both recovering addicts, Holland does not want "in any way shape or form to do anything that would violated Lindsay's probation or cause an arrest."

Davidson says, "A crime has quite simply not been committed by Ms. Lohan."

Probation Dept: Key Player in Lindsay's Freedom

Good news for Lindsay Lohan ... TMZ has learned the L.A. County Probation Department won't go after her for the alleged battery at the Betty Ford Center ... unless she's convicted.

Sources connected to the case tell us the Probation Department will not recommend to Judge Elden Fox that he violate her probation for the alleged assault when Lindsay appears on January 3. We're told the Department will only recommend action if Lindsay is convicted of criminal battery.

But it gets more complicated on the subject of alcohol. Under the terms of Lindsay's probation, she's required to comply with drug testing, including tests administered at Betty Ford. By refusing to submit to a breathalyzer test a week ago Sunday morning, Lindsay arguably violated this term of her probation.

We're told the Probation Department has not made a recommendation to the judge on violating her probation based on the breathalyzer test -- at least not so far.

Ultimately, it's up to Judge Fox. Worst case scenario for Lindsay ... back in the pokey for 6 months.

Lindsay Lohan: I Was Drinking Shirley Temples!

It all started when she showed up to her rehab facility 10 minutes after curfew, and was accused of smelling like alcohol, but the only thing Lindsay Lohan had to drink on the night in question were Shirley Temples.

Sources close to the “Mean Girls” actress claim that on December 11, Lohan met up with a friend at the Viceroy Hotel in Palm Springs, CA to get her hair done.

While in the salon, Linds knocked back a couple mixed, but apparently non-alcoholic, drinks - but when she showed up to her sober house around 1 am, employee Dawn Holland accused her of drinking booze.

Holland claimed she smelled alcohol on Lindsay's breath, but LiLo refused to take a breathalyzer.

Lindsay Lohan Snuck Out of Rehab for Alcohol

An employee of the clinic went public Tuesday with claims the actress was "out of control" and had alcohol on her breath during a tussle between them on Dec. 12.

Dawn Holland, a chemical technician at the desert rehab facility, gave her account in a video interview with TMZ, which included a copy of her report on the incident.

Within minutes of the story posting, Holland was fired.

"Regrettably," the Betty Ford Center said in a statement, "one of our employees violated strict confidentiality guidelines and laws by publically identifying patients in a media interview and by disclosing a privileged document."

According to Holland, Lohan and two other patients had "snuck out" and "went drinking," but were caught by another technician when they were "trying to jump over the back wall" to the clinic house in which they were living.

Holland was then called to administer Breathalyzer tests to the three patients when trouble erupted between her and a foul-mouthed Lohan, she says. "She was very angry and out of control," says Holland.

Police were called, and while Holland was on the phone with authorities, Lohan "grabbed my wrist and snatched it down" to try to wrest away the phone, sending Holland to the emergency room with a sprained right arm and hand, she says. Holland says she's now on worker's compensation leave.

Throughout the night, Lohan refused to submit to a Breathalyzer test and had apparently been drinking. "She had alcohol on her breath," says Holland, who denies being the aggressor. "I did not touch the woman," she says. "I am not willing to risk my job over any patient."

Lindsay Lohan: Don't Forget ... I'm The Victim!!!

Lindsay is squarely disputing the story chemical dependency technician Dawn Holland told TMZ ... that Lindsay attacked her and caused her to sprain her arm so severely she's on workers' comp. Lindsay says, for starters, she wasn't even with her two roommates hours before the incident. Lindsay says she was out getting her hair done.

Lindsay is telling her friends and family, when she returned to the house, Holland grabbed her abruptly and pushed her so hard, Lindsay began to cry.

Lindsay says that's when she went inside the house and called 911.

As for refusing to take a breathalyzer, Lindsay says she actually asked Holland to give her a test but Holland refused.

Lindsay claims there were not only witnesses that saw everything ... there are surveillance cameras to prove her story.

Lindsay Lohan's Alleged Abuse Victim Speaks

"Lindsay and two other patients had snuck out, went drinking and tried to sneak back in and they got caught. We were told by our administration on-call to do a breathalyzer test, which she refused to do," Holland tells TMZ. "She was angry and out of control."

According to Holland, the 24-year-old actress first pushed her after she asked the Mean Girls star to take her hands off another patient. When the four went inside the sober living facility, Holland says that Lohan "kept yelling and cursing and screaming" as she phoned the police.

"Then she tried to snatch the phone from out of my arm," Holland claims. "She grabbed my wrist and twisted my arm and my hand to get the phone."

Holland later went to the emergency room; she is currently out on workman's compensation because the injuries she sustained prohibit her from using her right hand.

The alleged incident is a misdemeanor; the Palm Desert Police Department's investigation is still ongoing.

"She was the only patient out of the three who was being very uncooperative and out of control," Holland adds of Lohan. "I did not touch the woman! I am not willing to risk my job over any patient."
